In this Policy, the controller is referred to as “ATS Breaker”, “we”, “us” or “our”.

2. Purpose of this Policy

This Policy explains how ATS Breaker collects, uses, accesses, stores, shares, transfers and deletes personal data relating to:

  • website visitors;
  • persons submitting a CV;
  • purchasers of the Service;
  • persons contacting ATS Breaker;
  • persons whose information appears in an uploaded CV.

ATS Breaker operates from the United Arab Emirates and processes data in accordance with applicable UAE data-protection requirements.

Where another mandatory data-protection law applies to a User, including the European General Data Protection Regulation where its territorial conditions are met, ATS Breaker will also respect the applicable mandatory requirements.

3. Data collected directly from Users

ATS Breaker may collect:

  • first name;
  • last name;
  • email address;
  • country or approximate location;
  • order reference;
  • payment status;
  • customer-support communications;
  • the original CV;
  • the reformatted CV;
  • information voluntarily provided by the User.

No User account is created.

ATS Breaker does not operate a newsletter and does not automatically subscribe Users to marketing emails.

4. Information contained in a CV

An uploaded CV may contain:

  • name and contact details;
  • telephone number;
  • postal address;
  • photograph;
  • date or place of birth;
  • nationality;
  • work-authorisation information;
  • employment history;
  • employer names;
  • job titles;
  • professional duties and achievements;
  • education and qualifications;
  • certifications;
  • technical and language skills;
  • professional profiles and portfolio links;
  • interests;
  • references;
  • other information voluntarily included by the User.

ATS Breaker only requires information reasonably necessary to reformat the CV.

5. Sensitive information

A CV may contain information that is sensitive or subject to enhanced legal protection, including information about:

  • health or disability;
  • racial or ethnic origin;
  • religion or beliefs;
  • political opinions;
  • trade-union membership;
  • sexual orientation;
  • criminal convictions;
  • national identification numbers;
  • biometric characteristics.

Users should remove sensitive information that is not necessary for their intended job application before uploading the document.

Users must not upload:

  • copies of passports or identity cards;
  • complete national identification numbers;
  • banking information;
  • medical records;
  • criminal-record documents;
  • passwords;
  • confidential information belonging to an employer;
  • information they are not legally authorised to disclose.

Where sensitive information is voluntarily included, ATS Breaker processes it only to the extent necessary to provide the requested Service or comply with a legal obligation.

6. Technical and website information

When the website is used, ATS Breaker and its technical providers may collect:

  • IP address;
  • browser type;
  • device type;
  • operating system;
  • pages viewed;
  • date and time of access;
  • referring page;
  • approximate geographic location;
  • cookie choices;
  • interactions with the website;
  • security and diagnostic logs.

7. Payment information

Payments are processed through Stripe.

ATS Breaker does not normally receive the User’s complete payment-card number.

ATS Breaker may receive:

  • payer name;
  • email address;
  • billing information;
  • amount and currency;
  • payment status;
  • transaction reference;
  • limited fraud-prevention information.

Stripe processes payment information under its own terms and privacy documentation.

8. Sources of personal data

Data is obtained:

  • directly from the User;
  • from the uploaded CV;
  • from website forms;
  • through email communications;
  • from Stripe in relation to payment;
  • automatically through cookies and technical logs;
  • from a person lawfully submitting a CV on someone else’s behalf.

9. Purposes of processing

ATS Breaker uses personal data to:

Provide the CV-reformatting Service

  • receive the document;
  • verify that it can be processed;
  • extract and organise its content;
  • reformat the CV;
  • generate the final PDF;
  • make the document available after payment;
  • communicate with the User.

Manage orders and payments

  • generate a payment link;
  • confirm payment;
  • issue receipts or transaction records;
  • prevent fraud;
  • manage payment disputes;
  • comply with accounting and legal obligations.

Operate and secure the website

  • process file uploads;
  • protect the website;
  • prevent malware or unauthorised access;
  • diagnose technical problems;
  • maintain logs;
  • ensure website functionality.

Manage legal obligations

  • respond to lawful requests;
  • establish, exercise or defend legal claims;
  • investigate suspected misuse;
  • comply with applicable laws.

Measure advertising performance

Where consent or another lawful basis is available, ATS Breaker may use Meta, TikTok and LinkedIn technologies to:

  • measure advertising campaigns;
  • understand how visitors reach the website;
  • create aggregated campaign statistics;
  • limit or improve advertising delivery.

10. Legal grounds

Depending on the applicable law and context, processing may be based on:

  • the User’s request to receive the Service;
  • performance of the contract;
  • the User’s consent;
  • compliance with legal obligations;
  • ATS Breaker’s legitimate interests in operating, securing and protecting the Service;
  • the establishment, exercise or defence of legal rights;
  • another basis permitted by applicable law.

Consent is requested where required, particularly for:

  • non-essential cookies;
  • advertising technologies;
  • the processing of certain information where consent is legally necessary.

Consent can be withdrawn at any time, without affecting processing lawfully performed before withdrawal.

11. Human processing

ATS Breaker provides a semi-automated service.

An authorised agent accesses and reviews the uploaded CV in order to:

  • understand its structure;
  • identify formatting issues;
  • prepare an ATS-friendly layout;
  • use the necessary digital tools;
  • generate and verify the final document.

Access is limited to persons who need the information to provide or support the Service.

12. Use of ChatGPT and Claude

An authorised ATS Breaker agent may submit the CV, extracted text or relevant sections of the CV through the ChatGPT or Claude websites.

These tools may be used to assist with:

  • document interpretation;
  • section identification;
  • formatting recommendations;
  • restructuring;
  • language presentation;
  • generation of a reformatted document.

ATS Breaker does not use these tools to make recruitment or hiring decisions.

ATS Breaker configures the accounts used for this processing so that submitted conversations are not voluntarily used to improve or train general-purpose AI models.

In particular, ATS Breaker must:

  • disable model-improvement settings;
  • use temporary or privacy-protective conversation modes where available;
  • avoid enabling memory for CV-processing conversations;
  • delete the conversations and uploaded files after processing;
  • avoid submitting information that is not necessary for the Service.

OpenAI and Anthropic may nevertheless retain deleted or temporary conversations in their back-end systems for up to 30 days for security, legal, fraud-prevention or technical purposes.

Where a provider is legally required to retain information for longer, its retention may exceed this period.

The use of ChatGPT and Claude therefore means that copies of CV information may remain with these providers after ATS Breaker has deleted its own operational copies.

13. No AI training by ATS Breaker

ATS Breaker does not:

  • train its own general-purpose AI model using Users’ CVs;
  • create a public CV database;
  • sell CV information;
  • voluntarily authorise ChatGPT or Claude to train their general models using submitted CVs;
  • use CVs as public examples without separate authorisation.

Users’ CVs may only be used to provide the requested Service, maintain security, comply with the law or manage a dispute.

14. No automated recruitment decision

ATS Breaker does not decide:

  • whether the User is qualified for a job;
  • whether an employer should interview the User;
  • whether an application should be accepted;
  • whether the User should be hired.

No legal or similarly significant employment decision is made by ATS Breaker solely through automated processing.

The User decides whether to accept, modify or use the generated PDF.

15. Service providers and recipients

Personal data may be accessed or processed by:

  • authorised ATS Breaker agents;
  • Uploadcare, for file uploading and temporary storage;
  • Stripe, for payment processing;
  • OpenAI/ChatGPT, where selected for AI-assisted processing;
  • Anthropic/Claude, where selected for AI-assisted processing;
  • OVHcloud and Zimbra, for hosting, domain or email services;
  • Webflow, where used for the website interface;
  • Meta, for advertising measurement where authorised;
  • TikTok, for advertising measurement where authorised;
  • LinkedIn, for advertising measurement where authorised;
  • professional advisers, insurers or accountants;
  • competent authorities where disclosure is legally required;
  • a lawful successor in the event of a restructuring or transfer of the business.

Only information reasonably necessary for the relevant purpose is shared.

ATS Breaker does not send CVs to employers, recruiters or job platforms.

16. Uploadcare storage

CVs are uploaded and temporarily stored using Uploadcare.

Uploadcare may process:

  • the uploaded file;
  • file metadata;
  • technical identifiers;
  • IP or security information;
  • access and delivery logs.

ATS Breaker manually deletes the original and final CV from the operational Uploadcare storage within the periods described below.

Technical records, logs or back-up copies controlled by Uploadcare may remain for limited periods in accordance with Uploadcare’s own legal, security and retention obligations.

17. International transfers

ATS Breaker is established in the United Arab Emirates and provides its Service internationally.

Personal data may be processed or accessed from:

  • the United Arab Emirates;
  • the European Economic Area;
  • the United Kingdom;
  • the United States;
  • other countries in which the technical providers operate.

Where the applicable law requires safeguards for an international transfer, ATS Breaker may rely on:

  • contractual data-protection clauses;
  • standard contractual clauses;
  • recognised transfer frameworks;
  • access controls and encryption;
  • service-provider security commitments;
  • another lawful transfer mechanism.

Users may contact ATS Breaker for more information about the providers used for a particular order.

18. Retention periods

ATS Breaker applies the following operational retention periods:

Original CV

The original PDF or Word document is manually deleted from ATS Breaker’s operational Uploadcare storage within 24 hours after completion of the reformatting process.

Final CV

The final reformatted PDF is manually deleted from ATS Breaker’s operational Uploadcare storage within 24 hours after it has been made available to the User.

The User is responsible for downloading and securely retaining their own copy during this period.

ATS Breaker cannot guarantee recovery after deletion.

ChatGPT and Claude conversations

ATS Breaker deletes the relevant conversation and uploaded file after processing.

OpenAI or Anthropic may retain the deleted or temporary information in their back-end systems for up to 30 days, subject to legal and security exceptions.

Payment and transaction records

Payment, invoice and transaction information is retained for the period required by applicable accounting, tax, consumer and commercial laws.

Email and support communications

Operational emails and support communications may be retained for up to 12 months after the request is closed, unless longer retention is necessary for a dispute, legal claim or legal obligation.

Security logs

Technical and security records may be retained for the period reasonably necessary to protect the Service, prevent fraud and investigate incidents.

Advertising information

Advertising and cookie data is retained according to the User’s choices and the retention settings of Meta, TikTok, LinkedIn and the website’s cookie-management system.

At the end of the relevant period, data is deleted, anonymised or securely archived where continued retention is legally required.

19. Manual deletion

Deletion of the original and final CV is performed manually by an authorised ATS Breaker agent.

ATS Breaker maintains an internal procedure requiring deletion within the stated 24-hour period.

Because deletion is manual, a technical or operational incident may exceptionally delay deletion.

Where this occurs, ATS Breaker will delete the file as soon as reasonably possible.

20. Security

ATS Breaker implements reasonable technical and organisational measures designed to protect personal data against:

  • unauthorised access;
  • loss;
  • alteration;
  • disclosure;
  • destruction;
  • unlawful use.

Measures may include:

  • restricted access;
  • password protection;
  • secure transmission;
  • limited retention;
  • deletion procedures;
  • malware and security controls;
  • privacy settings for AI tools;
  • use of recognised technical providers;
  • incident-response procedures.

No online service can guarantee absolute security.

Users should remove unnecessary sensitive information before uploading their CV.

21. Cookies and advertising technologies

The website may use:

Necessary cookies

These are used for:

  • website operation;
  • security;
  • form submission;
  • file uploading;
  • payment;
  • recording cookie preferences.

Advertising and analytics technologies

Subject to the User’s consent where required, the website may use:

  • Meta Pixel or equivalent Meta technologies;
  • TikTok Pixel;
  • LinkedIn Insight Tag.

These tools may collect:

  • IP address;
  • browser or device information;
  • page visits;
  • interactions with the website;
  • campaign information;
  • conversion events.

Non-essential cookies and advertising technologies must not be activated before consent where consent is legally required.

The User may modify or withdraw their choice through the website’s cookie-management tool.

ATS Breaker does not use advertising pixels to read or analyse the content of uploaded CVs.

22. No newsletter

ATS Breaker does not automatically add Users to a newsletter or general marketing list.

The email address provided is used primarily to:

  • identify the request;
  • communicate about processing;
  • send or provide access to the payment link;
  • support access to the final document;
  • respond to a complaint or legal request.

If marketing communications are introduced in the future, an appropriate lawful basis and unsubscribe mechanism will be implemented.

23. Information about third parties

A CV may contain information about:

  • referees;
  • managers;
  • colleagues;
  • clients;
  • professional contacts.

The User must ensure that they are authorised to provide this information and that it is relevant to the CV.

ATS Breaker recommends avoiding unnecessary private telephone numbers, home addresses or personal details concerning references.

24. Data-subject rights

Depending on the law applicable to the person, they may have the right to request:

  • confirmation that their data is being processed;
  • access to their personal data;
  • correction of inaccurate information;
  • completion of incomplete information;
  • deletion of certain information;
  • restriction of processing;
  • objection to certain processing;
  • withdrawal of consent;
  • portability where applicable;
  • information concerning recipients;
  • information concerning international transfers;
  • human intervention concerning certain automated processing;
  • cessation of marketing communications.

ATS Breaker may request reasonable proof of identity to prevent fraudulent access or deletion.

25. Deletion requests

Because operational CV files are normally deleted within 24 hours, ATS Breaker may no longer hold the requested document when the request is received.

Deletion from ATS Breaker’s systems does not necessarily cause immediate deletion from:

  • Stripe’s legally required transaction records;
  • technical provider back-ups;
  • OpenAI’s systems;
  • Anthropic’s systems;
  • security or fraud-prevention logs.

Those providers may apply their own deletion and retention periods.

26. Complaints

Questions or complaints concerning personal data may be sent to:

A person may also contact the competent data-protection authority where the applicable law gives them that right.

27. Children

ATS Breaker is intended exclusively for persons aged 18 or over.

ATS Breaker does not knowingly accept CVs or purchases directly from minors.

Where ATS Breaker becomes aware that a minor has submitted information, the request may be cancelled and the information deleted.

28. Third-party websites

The ATS Breaker website may contain links to Stripe, social networks or other third-party websites.

Those organisations process personal data under their own privacy policies.

ATS Breaker is not responsible for their independent processing activities.

29. Changes to this Policy

ATS Breaker may update this Policy to reflect:

  • changes to the Service;
  • changes to technical providers;
  • new advertising tools;
  • legal or regulatory developments;
  • changes to retention practices;
  • security improvements.

The updated version will be published with a revised date.
